We Can Fix It All (collectively, “We Can Fix It All”, “we”, “us”, or “our”) is pleased to offer you our website and other online services that may link to these Terms of Use or on which these Terms of Use appear, as well as the content, features, and software available on them (collectively, the “Online Services”). These Terms of Use form an agreement between We Can Fix It All and you and set forth the terms and conditions upon which we make the Online Services available to you. You must be 18 years of age or older to use the Online Services.
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE ONLINE SERVICES. THESE TERMS OF USE CONTAIN PROVISIONS THAT LIMIT YOUR LEGAL RIGHTS, INCLUDING AN ARBITRATION PROVISION, WAIVERS OF CLASS ACTIONS AND JURY TRIALS, AND LIMITATIONS ON OUR LIABILITY. YOUR USE OF THE ONLINE SERVICES CONFIRMS YOUR UNCONDITIONAL ACCEPTANCE OF THESE TERMS OF USE. IF YOU DO NOT ACCEPT THESE TERMS OF USE AND ALL POLICIES, TERMS, AND CONDITIONS STATED OR INCORPORATED BY REFERENCE IN THESE TERMS OF USE, INCLUDING OUR PRIVACY POLICY, YOU ARE PROHIBITED FROM, AND MUST IMMEDIATELY CEASE, ACCESSING OR USING THE ONLINE SERVICES.

We Can Fix It All strives to ensure that information regarding our services is complete, accurate, and current. Despite our efforts, such service information and other content on the Online Services may occasionally be inaccurate, incomplete, or out of date. We make no representation regarding the completeness, accuracy, timeliness, usefulness, or other attributes of such information, and any reliance you place on it is strictly at your own risk.Our services, which may be provided by our employees or hired subcontractors depending on availability in your area, are offered subject to our acceptance of your booking request. We reserve the right to refuse service to any request, person, or entity without the obligation to assign a reason. - Intellectual Property and Ownership; License
The Online Services, including their design, contents, features, and functionality, and all proprietary and intellectual property rights therein, are owned or controlled by us, our licensors, or other providers of such material, and are protected by copyright, trademark, and other laws. They may not be copied or used (including in “meta-tags” or “hidden text”) except as permitted in these Terms of Use or with prior written permission. Subject to your continued compliance, we grant you a limited, revocable, non-exclusive license to temporarily access, use, and display the Online Services on your device for non-commercial personal use only. We reserve all rights not expressly granted. Unauthorized reproduction, modification, public display, performance, distribution, or commercial use is prohibited. This license terminates automatically if you violate these Terms, and we may terminate it at any time for any reason with or without notice. - Third-Party Links
The Online Services may contain links to websites, applications, platforms, or services not owned, operated, or controlled by us (collectively, “Third-Party Services”). Using these links will take you away from our Online Services. These links are provided for convenience, and your use of Third-Party Services is at your own risk. We are not responsible for or endorse any Third-Party Services, products, services, content, or information available thereon. - Prohibited Conduct
You agree to use the Online Services in compliance with these Terms and all applicable laws. You are prohibited from posting or transmitting unlawful, threatening, defamatory, obscene, pornographic, or profane material, or anything that could encourage criminal conduct or violate any law. You also agree not to: (i) bypass technical features limiting use or access; (ii) disrupt or harm the Online Services or networks; (iii) infringe intellectual property rights; (iv) submit harmful software; (v) interfere with other users; (vi) violate laws; (vii) use automated devices to monitor or copy content; (viii) harvest or distribute information; (ix) transmit unsolicited communications; (x) use false identities; (xi) violate others’ rights or harass anyone; or (xii) conduct denial of service attacks. We may take action, including referral to law enforcement, to address violations. - Digital Millennium Copyright Act Notice Policy
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (“DMCA”) takedown procedures. It is our policy to terminate access for repeat infringers. If you believe your work is infringed on our Online Services, contact us at the address below with: (1) an electronic or physical signature of the copyright owner or authorized agent; (2) a description of the copyrighted work and its location on the Online Services; (3) your address, phone number, and email; (4) a statement of good faith belief in unauthorized use; and (5) a statement under penalty of perjury confirming accuracy. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE ONLINE SERVICES. THEY ARE PROVIDED “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ACCURACY, COMPLETENESS, OR AVAILABILITY. WE DO NOT GUARANTEE ERROR-FREE OPERATION, INTERRUPTION-FREE USE, OR FREEDOM FROM VIRUSES. THESE EXCLUSIONS DO NOT APPLY WHERE PROHIBITED BY LAW; CHECK YOUR LOCAL LAWS. - Limitations of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR DAMAGES TO YOUR PROPERTY OR DEVICES FROM USING THE ONLINE SERVICES, NOR FOR INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR DATA) ARISING FROM USE OR INABILITY TO USE THE ONLINE SERVICES, REGARDLESS OF LEGAL THEORY. Homeowners release us from liability for damage to property or payment disputes caused by subcontractors, who are solely responsible for collecting payment. Your sole remedy for any issue is to cease using the Online Services. We collect a non-refundable travel fee per service call, refundable only if the scheduled handyman does not show up. These limitations do not apply where prohibited by law; check your local laws. - Refunds and Returns: We Can Fix It All will provide refunds if we, our franchisees, or their employees fail to perform services to a satisfactory standard. In such cases, the customer must contact us immediately and before paying the dispatched handyman at the customer’s home, business, or other location. Payment to the handyman will be reasonably interpreted as the customer’s satisfaction with the services rendered. We reserve the right to hire subcontractors when no handyman employee is available in the customer’s area, and no refunds will be issued for payments made to subcontractor handymen; refund requests in these instances must be directed to the subcontractor. We Can Fix It All collects a travel fee that varies per service call, which is refundable only if the scheduled handyman does not show up as planned; otherwise, the travel fee is non-refundable.
- Dispute Resolution; Arbitration; Prohibition of Class ActionsThis section is a “written agreement to arbitrate” under the Federal Arbitration Act. Disputes will be resolved per this section. YOU AND WE AGREE THAT ALL CLAIMS BETWEEN US RELATED TO THE ONLINE SERVICES WILL BE RESOLVED EXCLUSIVELY THROUGH CONFIDENTIAL, BINDING ARBITRATION, EXCEPT FOR ACTIONS TO ENJOIN INTELLECTUAL PROPERTY INFRINGEMENT. YOU WAIVE THE RIGHT TO A COURT TRIAL.Pre-Arbitration Dispute Resolution: Before legal action, send a written Demand to us at 501 Union St, Nashville, TN 37219. The Demand must be personally signed, seek only your individual dispute, and include supporting documentation. Within 20 business days, we may request a video or telephone conference, which both parties must attend. No legal action may be taken until 20 days after the conference request period expires or 20 days after the conference if requested. This is a mandatory condition precedent to arbitration.Arbitration Procedure: If unresolved within 10 business days after the conference (or 10 days if no conference is requested), file with the American Arbitration Association (“AAA”). Arbitration follows AAA rules, including Consumer Rules, modified by this agreement, and occurs in your county or a mutually agreed location. For claims under $10,000, either party may elect telephone/video or written proceedings, subject to the arbitrator’s discretion. The arbitrator applies local law and honors privileges.Class Action Waiver: Claims must be brought individually, not as part of a class or representative action, unless both parties agree. The arbitrator may only award relief for the individual claimant. If unenforceable, this waiver remains in effect in any forum. YOU WAIVE CLASS ACTION RIGHTS. The award is confidential and final.
- Choice of LawThese Terms are governed by Tennessee law, without regard to conflict of law principles. For non-arbitrable disputes, you consent to the exclusive jurisdiction of Tennessee courts.
- Indemnity
You agree to indemnify and hold harmless We Can Fix It All, its affiliates, and their officers, directors, employees, and agents from claims, liabilities, or losses arising from your breach of these Terms, violation of law, or use of the Online Services. - Miscellaneous
No delay in enforcing these Terms waives our rights. Invalid provisions do not affect the rest. Headings are for convenience only. “Including” means “including, without limitation.” Use of the Online Services must comply with applicable export laws.
